Introduction

On August 23rd, 2021, the BC government announced they were moving forward with their plan to implement a Biometric identification (ID) and social credit system in B.C. that is tied to peoples'  COVID-19 vaccine status. This is euphemistically being referred to as, "Proof of Vaccination" (POV) and the "BC Vaccine Card." These terms are code for Biometric ID. 

This creates a convergence, or fusion, of ones' biological, digital, and physiological identity, vaccination and social status. Vaccine passports create social credit, or status, based on ones' vaccination status. BC's system is building upon, and adopting the Chinese Communist Party (CCP) government's vaccine status and social credit systems of state control, coercion, and surveillance tied to biometric data and ID. Under the BCNDP government, the ability to participate in BC society will rely upon whether one is up-to-date with what the state tells citizens is their vaccination status. This formalizes governmental, institutional, and state definitions of who is considered an "insider," "desirable," or "worthy person," and who must be considered an "outsider," an "undesirable" or "unworthy" person in BC. 

Adrian Dix, Minister of Health under the BCNDP, and Justin Trudeau, former Prime Minister with the federal Liberal Party, have both advised citizens that boosters are already being considered. This is because there is already statistical data from the BC Centre for Disease Control (BCCDC) and Canadian governments (as well as others') that COVID-19 vaccines do not work as intended for specific populations, such as the elderly, and those with immune-suppression. 

There are also strong indicators the vaccines wane within several months. The World Health Organization (WHO) states that "booster shots" have no scientific data to support them. However, some nations, most notably Israel, have already been administering third doses of COVID-19 vaccines. They are also already considering administering four doses in the first year that these experimental vaccines have been administered around the world. 

Trudeau has publicly stated he has ordered "booster" doses, or "second generation" vaccines up to 2024. People will be required to take the state-sponsored and required number of vaccines, which will change over time. If they do not take them, their status in their passport/Biometric ID will show they are "unvaccinated." Their social credit and status will change. They will be socially and physically banned and excluded from all of the settings the B.C. government has decided will require this proof. That list will grow as the months go by. 

What is Biometric Identification (ID)

  • Biometrics is defined as: the measurement and analysis of unique physical or behavioral characteristics (such as fingerprint or voice patterns) especially as a means of verifying personal identity (Merriam-Webster).

  • Biometrics are physical or behavioral human characteristics to that can be used to digitally identify a person to grant access to systems, devices or data (Korolov, 2019).

  • Biometric identification (ID): Biometric identification consists of determining the identity of a person. The aim is to capture an item of biometric data from this person. It can be a photo of their face, a record of their voice, or an image of their fingerprint (Thales, 2021). 

  • Biometric ID now includes COVID-19 vaccination status. Over time, this information will potentially increase to include other biomedical personal information, which will confer social status and credit, and the ability to access services, and participate in ones' community.

On Sept. 7th more details about the BCNDP & #BCgovernment's implementation of their Biometric ID and social credit system via the "BC Vaccine Card" were released. Details are provided below. The picture above is what your vaccine status will look like in the BC COVID-19 vaccine app.


Bioethical, Socio-Economic, and Social Justice Analysis

BC Vaccine Passport: "Proof of Vaccination" is the coercive collection, use, and forced disclosure of personal health information and biometric data via BC vaccine passports. This represents a substantive violation of health-related ethics, bioethics, civil and human rights, and a variety of provincial, federal, and international laws, including the Universal Declaration on Bioethics and Human Rights (2005). The background and mandate of this international declaration states: "At its 32nd session in October 2003, the General Conference considered that it was “opportune and desirable to set universal standards in the field of bioethics with due regard for human dignity and human rights and freedoms, in the spirit of cultural pluralism inherent in bioethics” (32 C/Res. 24).
  • Social Exclusion, Marginalization and Barriers to Participating in Society: Many individuals and classes of people will be banned and further marginalized from participating in society through the BC government's implementation of their social credit system. The BCNDP government is increasing barriers, creating institutional barriers, and excluding more and more people who they have decided are "unworthy" of being included in their communities, and BC society. This includes: poor and soci-economically disadvantaged people; people who have no PHN, no smartphones, and no access to the internet. People with inaccurate, or wrong ID. Seniors who may not know how to use technology, or how to navigate complex systems to access their biometric ID. People with disabilities and health conditions which prevent them from getting COVID-19 vaccines, and people who object to getting these vaccines for religious reasons, or conscientious objections will all be considered to have no social status in BC.
  • No "Do Over" - If/once you choose to download the BC Vaccine passport you will never again have autonomy, freedom, or liberty, or self-determination over your personal or health sovereignty. The state will own you, your biometric data, & your body forever. The state will also decide what health interventions you will be required to have in the future to maintain your social credit and status in BC (and later, in Canada). Once you give your own personal and health sovereignty, bodily autonomy and integrity away you will remain enslaved for the rest of your life, or you will become a non-status person.
  • In the case of COVID-19 vaccines: If you do not keep getting boosters when your COVID-19 vaccine has "expired" you will no longer have social status, or "social credit." You will be considered "unvaccinated." This means you will be banned from accessing the settings the province has decided you will be excluded from. This list will grow over time. They're rolling out all of the plans incrementally.
  • There are NO EXEMPTIONS: This includes no exemptions even if you/a loved one has medical, or religious reasons for not receiving a vaccine (now it's just COVID-19 ones, but new vaccines will roll out later that you will be required to take). This means if you had 1 dose and had a bad reaction, and can't get a second dose (or third, fourth, fifth...), you will be considered unvaccinated and banned from participating in society.

How BC's Biometric ID Will Work

Downloading the App: To download the app you need your Personal Health Number (PHN); your date of birth; and the date of your 1st or 2nd vaccine dose. If you do not have a PHN, or smartphone, obviously you will be unable to use this app.

After inputting your biometric data: You will receive a BC vaccine card with a QR code that shows how many doses of the vaccine you’ve received.

You will need to show your QR code—either digital or paper—along with photo ID before entering specific events and settings.

Businesses will use a phone app to verify customers’ vaccination statuses. This means BC businesses and other settings will now be collecting customers' Biometric & personal health information. Details about how, where, and what country/ies this data and information will be stored in, and whether third parties can access this data, and share it are not known at this time.

Permissions and Informed Consent: If you are going to download the BC Biometric app, ensure you have carefully read the Permissions and Consents that are required. These should tell you how, where, what country and whether third party access to your biometric and personal health information will be used. Permissions should also tell you if third parties can also share your personal health/biometric data, and for what purposes.

Exempted businesses and settings: Settings that have been designated as "Essential; "Fast food" restaurants, food courts, drive-thrus, and cafeterias are not included in the program.


Cybersecurity Threats from Biometric ID, Vaccine Apps and Potential Risk Mitigation Strategies
  • IT Security and privacy experts have already reported that COVID-related apps are highly targeted for hacking and cybersecurity breaches by cyber-criminals. This is because the information contained in these apps is probably enough to steal a person's identity and commit other crimes in their name, specifically financial crimes.
  • Protecting Your Biometric Data and Personal Information: Consider getting an IT security assessment of your phone, and existing permissions from other apps and the phone manufacturer.
  • Additional Cybersecurity On Your Phone: Consider getting expert advice about adding additional layers of cybersecurity on your smartphone if you plan to download the app. Biometric ID and apps likely come with ongoing and chronic cybersecurity risks for you, and your personal health and biometric data.
  • Unknown Risks and Threats to Children & Youth: Because all of this is being implemented so quickly, with many parts unknown, and so many kids have smartphones, it is unclear to me what steps parents will be able to take to protect and decrease risks and threats from predators and cyber-criminals who will try to access the biometric and personal health information of their kids.
  • Suggestions for Parents: Not allow their kids to download the Biometric ID's onto their phones until more is known about the risks and threats. Ensure that parents are present and aware of the permissions and consents if the app is downloaded. Try to do an IT cybersecurity assessment and install cybersecurity protections on their kids' phones.

Places your vaccine card is required for entry in BC

By order of the Provincial Health Officer (PHO), proof of vaccination is required to access some events, services and businesses. Starting September 13, you must have at least one dose of a COVID-19 vaccine. By October 24, you must be fully vaccinated. The requirement is in place until January 31, 2022 and could be extended. 

The requirement applies to all people born in 2009 or earlier (12+) and covers:

  • Indoor ticketed sporting events
  • Indoor concerts, theatre, dance and symphony events
  • Licensed restaurants and restaurants that offer table service (indoor and patio dining)
  • Pubs, bars and lounges (indoor and patio dining)
  • Nightclubs, casinos and movie theatres
  • Gyms, exercise facilities/studios, pools and recreation facilities
  • Businesses offering indoor group exercise
  • Indoor adult group and team sports for people 22 years old or older
  • Indoor organized events with 50 or more people. For example: Wedding receptions, organized parties, conferences and workshops
  • Indoor organized group recreational classes and activities like pottery, art and choir
  • Post-secondary on-campus student housing

Introduction

The pace at which employers in different sectors are making experimental COVID-19 vaccines mandatory for workers has dramatically picked up. This is leaving many workers shaken, fearful, and concerned about their health, safety, and well-being at work. In this article, I'm providing some resources people can use to inform themselves, their employers and unions regarding the vaccines.

Workplace Safety in BC: Workers Compensation Act and WorkSafeBC

The Workers Compensation Act is the law in B.C. that employers, workers, and supervisors who manage on behalf of employers, must be compliant with in workplace settings.

Joint Occupational Health and Safety Committees (JOHS)
  • Employers with over 20 employees at a location are legally required to have a JOHS, which has worker and employer representatives on it. 
  • Workplace injuries and accidents are reportable to JOHS's. They are legally required to investigate these reports, issue reports and recommendations based on the findings of the workplace investigations. 
  • If employers are requiring workers to get vaccinated, and the worker experiences Adverse health reactions, injuries, and/or death from the COVID-19 vaccine these should be considered reportable workplace incidents and injuries
  • These workplace injuries should also be reported by the worker and the employer to WorkSafeBC. This should be done regardless of whether workers file workplace injury claims for compensation with WorkSafeBC.

Occupational Health and Safety Regulation ("OHS Regulation")

  • The Occupational Health and Safety Regulation ("OHS Regulation) is the regulatory framework that employers and workers must also follow to ensure workplaces are as safe as possible for everyone. 

  • The purpose of the Regulation is to promote occupational health and safety and to protect workers and other persons present at workplaces from work-related risks to their health, safety, and well-being. 

  • Compliance with the requirements provides the basis on which workers and employers, in cooperation, can solve workplace health and safety problems.

Claims and COVID-19 vaccination

  • When could an adverse reaction to the COVID-19 vaccine be work-related?
➤ If a worker submits a claim for an adverse health reactions, injury, or death from the COVID-19 vaccine, it would have to be shown that the adverse reaction, injury, or death arose out of and in the course of the worker’s employment. WorkSafeBC considers:

1. Whether the COVID-19 vaccination was a mandatory requirement of employment.

2. If the worker sustained an injury (or death) as a result of the COVID-19 vaccination.


What To Do If Your Employer is Telling You that COVID-19 Vaccines Are Mandatory

Consult an employment lawyer to find out what your legal rights are. 

Speak with your Union (if you have one) to find out what your legal rights are. 

Speak with your Family Doctor/GP about getting a medical exemption letter if you don't believe it is safe, or healthy for you to get the vaccine.

➤ If you don't agree with this, begin to look for another job ASAP. Any employer, industry, or sector that would mandate vaccines must be seen as one to be avoided. They are toxic bullies, and unsafe employers. Once they implement these kinds of mandates there is no stopping what other kinds of harmful and unsafe actions they will take toward workers. 

➤ If you work in an industry that vaccines are being mandated in, such as Long-term care and Assisted Living, consider making a career change if you don't agree with this, or determine if you can live with the employers' requirements for not getting the vaccine. Ie. wearing a mask, or other PPE while on shift. 

➤ If you are experiencing serious mental or physical health issues regarding the stress and anxiety related to your employer's demands and forced vaccinations, consider going on a medical (stress) leave and speak with your doctor about this if you have Short-term disability benefits and request they to complete the required paperwork.

Joint Occupational Health and Safety committee: Bring the issue of mandatory vaccination and Adverse health reactions/injuries forward to your JOHS committee at work. Request they send out a communication to ALL workers in the organization so workers are informed about:

1. What to do if they cannot get the vaccines due to specific health and safety issues and what accommodations the employer has set up to manage these situations. 

2. How and where to report vaccine-related Adverse health reactions and injuries to the employer. 

3. The names and contact information of worker representatives on the JOHS committee and shop stewards that workers can speak with about vaccines and vaccine-related Adverse health reactions and injuries. 

4. How to report vaccine-related Adverse health reactions and injuries to WorkSafeBC as workplace injuries. 

5. The best ways to document Adverse health reactions injuries for injury reports and WorkSafeBC claims. 

Consider letting your employer terminate your employment for exercising your LEGAL right to Informed Consent by delaying, or not getting a COVID-19 vaccine. Seek legal consultation whether you would be able to sue for Termination Without Cause, or other reasons. You may also be eligible for Employment Insurance (EI) if you are terminated for this reason. 

➤ Consider issuing a Notice of Liability (NOL) to your employer for forcing experimental vaccines on you as a condition of employment.

Documentation of Employment Matters Related to Vaccines

■ If you were going to have to take legal action, or file a grievance, or WorkSafeBC claim related to work-related Adverse health reaction/injuries from vaccines, you will need documentation to support your case/claim. 

■ If you do a legal consultation, make sure to ask what documents you should collect and store if they were going to be needed in the future. 

■ Document and get everything in writing regarding mandatory vaccines, or employer's policies on vaccines, especially if they are mandating them. 

■ Save all employer emails, memos and communications about vaccine policies at home. 

■ Ask questions via email and keep copies at home in a secure place. 

■ Keep copies of all medical exemption and accommodation paperwork and Adverse health reaction/injury medical documents at home in a secure place. 

■ Collect employer employment policies and employment hiring letters and other documentation at home in a secure place.  


Extended Health Insurance Coverage Consultation

■ BEFORE you get a COVID-19 vaccine, call and speak with (and record the conversation) a representative for your Extended Health, and/or Private Insurance policy and plan to determine the following:

  • Will Short-term or Long-term disability coverage be provided if I experience a work-related COVID-19 vaccine injury?

  • Will life insurance be paid out to my loved ones/estate if I were to die from complications related to the COVID-19 vaccine injury/Adverse Health reactions?

  • Is there anything else I need to know about how my/my employer's specific extended health and insurance policy works regarding COVID-19 vaccines?

Informed Consent within the Context of COVID-19 Vaccines

The article below contains a series of questions that workers can send to their employers to ensure that they are fully aware of how employers will handle the situation if workers get the vaccines that their employers are requesting, or requiring they get. Put these into an email and keep copies of all responses and engagement with the employer at home. 

■ If you experience a vaccine injury, or serious Adverse Health reactions and cannot work, are temporarily, or  permanently disabled, or die, you need to know what financial and other support will be there from your employer BEFORE you get the vaccine. If you have dependents, you also need to know what would happen to them if you were no longer there to support them financially.

Disclaimer and Introduction 

I am not a lawyer. I write this article from the perspective of a public interest advocate who believes the citizens and taxpayers of British Columbia have a right to accountable, open, and transparent governance, information, updates and changes that the BCNDP government has carried out under the guise of "managing" SARS-CoV-2 and COVID-19. 

This article contains analysis and links to B.C. government orders, regulations and laws that give the BCNDP unrestrained governmental, state, and institutional power and control over the lives of the people of B.C. I would argue that the legislative and regulatory powers that the BCNDP have brought in are draconian and totalitarian in nature. The usual checks and balances that occur in a system of parliamentary democracy -- the voices and advocacy of our elected officials, Members of the Legislature (MLA), have been entirely silenced, undermined, and rendered obsolete in B.C., regarding any measures taken under the guise of COVID-19, and the legislative scheme the BCNDP have brought in and maintained. 

It is my personal opinion and belief that the BCNDP government has catastrophically failed the public interest in B.C. through their actions since SARS-CoV-2 and COVID-19 were identified in B.C. It is also my personal belief and perspective that the BCNDP are continuing to fail the citizens of B.C. by continuing the undemocratic, draconian, and totalitarian manner of governing B.C. under the CRMA and through their actions, which have led to many harms to the people of our province. 

BCNDP Government Updates to Existing COVID-19 Legal and Regulations

The B.C. government has quietly been updating and ending some COVID-19-related orders in the last few weeks. I wrote an article that provided an overview of some of these previous orders and updates that can be seen here:

COVID-19 Related Measures Act (CRMA) 

In June 2020 I wrote an article about the dangers and the draconian and undemocratic nature, and risks of Bill 19, which would become the CRMA, when David Eby, Attorney General of B.C. introduced Bill 19 into the B.C. Legislature for first reading on June 22nd, 2020. While the citizens of B.C. were reeling from all of the draconian, harmful, and destructive measures the BCNDP government brought in to the "manage" COVID-19, Bill 19 was rammed through the legislature from June 22nd to July 8th, 2020 when it received Royal Assent. This is how the COVID-19 Related Measures Act (CRMA) became a law in B.C. that has been used to control, limit, restrain, and restrict the lives of the citizens of B.C. for over a year now. There is no end in site for this now that the BCNDP gave themselves this authoritarian legislative power and control.

The key problems with CRMA include the following: 

It transformed BC from a parliamentary democracy to a one-party totalitarian state. It gave the BCNDP unchecked power to do anything they want -- as long as they say their orders and amendments are done under the CRMA

It sidelined parliamentary democratic process and left elected Members of the Legislature (MLA's) with no input, or voice into how the BCNDP government runs government, including the draconian measures to "manage" COVID-19 which have led to substantive harm and damages for many individuals and groups in B.C. 

It gave the BCNDP government the ability to make unilateral changes to regulations and laws without bringing them to the Legislature for debate, amendments, or voting by our elected representatives, MLA's. 

CRMA gives the BCNDP government completely unrestrained legislative control and dominance of BC under the guise of COVID-19. This is why B.C. has to be considered a one-party totalitarian state in which democracy has failed. 

CRMA gives the BCNP government sweeping, unchallenged and unchecked powers to enact other  authoritarian orders and measures. The BCNDP have used this power to control, limit, restrict and restrain the lives of the citizens of B.C. since March 18th, 2020. Many of the measures they have carried out have violated the Canadian Charter of Rights and Freedoms of citizens.

BC Government Ended Longest State of Emergency in BC History

On June 30th, 2021, the BCNDP government ended the State of Emergency (SOE) they had issued under the Emergency Program Act (EPA) on March 18th, 2020. This was the longest SOE in B.C. history. It was carried out under the guise of "managing" COVID-19.

BC Government Extends CRMA to December 31, 2021

On June 29th, 2021, in a series of secretive and unaccountable actions that have not been widely reported, the BCNDP government amended the CRMA in the following ways:

Extended the CRMA to December 31st, 2021. They changed the 1 year "sunset clause" that was contained in this legislation to bring an end to this draconian and undemocratic legislation. They have now extended their undemocratic legislative power under the CRMA to the end of the year – IN THE ABSENCE OF ANY MATERIAL EVIDENCE THIS IS NECESSARY. (See below for the most up-to-date statistics on COVID-19 in B.C.). 

 Issued Ministerial Order MO. 273 (June 28, 2021), which states:

I, Mike Farnworth, Minister of Public Safety and Solicitor General, order that, effective June 30, 2021,

 (a) the Protective Measures (COVID-19) Order made by Ministerial Order 13/2021 is repealed, and 

(b) the attached Protective Measures (COVID-19) Order No. 2 is made.

Note: The "Protective Measures (COVID-19) Order 2" amendments allow the BCNDP government to continue to control, limit, constrain, restrict and fine citizens and business owners in B.C. regarding gatherings, events, and continue to limit and impact businesses that serve food and liquor, including limitations on the numbers of people who can enter businesses. The economic and financial destruction, hardship, and devastation the BCNDP government has caused through their use of these orders and the CRMA, leading to many businesses in B.C. going bankrupt, cannot be over-stated. 

➤ Amended the regulation as follows:

Regulation 165/2021 (O.I.C) 372/2021) amends Schedule 2 of CRMA by adding the M273/2021 – Protective Measures (COVID-19) Order No. 2 made under the Emergency Program Act on June 28, 2021 as Item 23.8, which is effective until December 31, 2021.

➤ Has extended protection from damages for civil liability under the CRMA for various businesses and organizations, including long-term care (LTC) operators. It is important to note they are not protected from damages when gross negligence can be proven. 

Has kept in place draconian legislation while failing to recognize that COVID-19 does not have any epidemiological significance in B.C. at this time, according to the BC Centre for Disease Control's reports (see below).  

Appears to be positioning itself to be able to continue to use the CRMA to indefinitely control, constrain, limit and restrict the lives of the citizens, business owners, and taxpayers of B.C.  – IN THE ABSENCE OF ANY MATERIAL EVIDENCE THIS IS NECESSARY. 

The BCNDP government has NOT:

Updated Schedule 2 of the CRMA to include Item 23.8

Made Item 23.8 available, or  easily accessible to the public.

Has not updated the BC government webpage where these regulatory amendments, changes, and updates should appear so that citizens and others in B.C. have openness and transparency about their legal actions and planning.  

Demonstrated any accountability, openness, or transparency about extending the CRMA to December 31st, 2021, or any of the other regulatory changes and updates they have added to it.
